Introduction<\/strong><\/h1>\n\n\n\n<p><strong>1.1<\/strong><br>When you accept an offer of admission from Apsley Business School (\u201cthe Institution\u201d) and&nbsp;satisfy any conditions which&nbsp;the Institution may have attached to the offer, a&nbsp;contractual relationship is&nbsp;established between you and&nbsp;the Institution (\u201cus\u201d). It is&nbsp;important that&nbsp;you understand this Contract because&nbsp;it identifies the terms that&nbsp;govern the contractual relationship between us. You will be asked to accept this Contract once&nbsp;the Institution has confirmed that&nbsp;all the conditions required for&nbsp;you to enrol at&nbsp;the Institution have been satisfied.<\/p>\n\n\n\n<p><strong>1.2<\/strong><br>Before accepting an offer of admission, and&nbsp;before&nbsp;you enrol, you must read this Contract in&nbsp;full and&nbsp;raise any questions with the Institution if&nbsp;there is&nbsp;any part of it that&nbsp;you do not understand, using the contact details below:<\/p>\n\n\n\n<p><strong>Registry<\/strong><br>Third Floor Apsley House<br>London SW15 2SH<br><a href=\"http:\/\/www.apsley.eu\">www.apsley.eu<\/a><br><a>admission.support@apsley.university<\/a><\/p>\n\n\n\n<p><strong>1.3<\/strong><br>This Contract is&nbsp;reviewed and&nbsp;updated annually. You are required to read and&nbsp;accept its terms and&nbsp;conditions each year when&nbsp;you enrol.<\/p>\n\n\n\n<hr class=\"wp-block-separator\"\/>\n\n\n\n<h1><strong>2. Rules and&nbsp;Regulations<\/strong><\/h1>\n\n\n\n<p><strong>2.1<\/strong><br>You agree as&nbsp;part of the Contract to abide by the Institution\u2019s rules, regulations, policies, procedures and&nbsp;codes (collectively referred to as&nbsp;\u201crules and&nbsp;regulations\u201d) that&nbsp;are in&nbsp;force at&nbsp;any given time. These include, in&nbsp;particular: rules relating to academic study; learning and&nbsp;assessment; conduct and&nbsp;discipline; fitness to study; use of services and&nbsp;facilities; payment of fees and&nbsp;expenses; health and&nbsp;safety; and&nbsp;intellectual property. Such rules and&nbsp;regulations are available on&nbsp;the website and&nbsp;inside the Online Learning Portal.<\/p>\n\n\n\n<p><strong>2.2<\/strong><br>You should read these rules and&nbsp;regulations carefully, as&nbsp;breach of them may lead to the imposition of sanctions by the Institution, including your expulsion from the Institution.<\/p>\n\n\n\n<p><strong>2.3<\/strong><br>If you are registered on&nbsp;a&nbsp;programme of study that&nbsp;leads to a&nbsp;professional qualification such as&nbsp;teaching, nursing or&nbsp;counselling psychology, you may also be subject to the Fitness to Practise policy and&nbsp;procedure. Such regulations are drafted in&nbsp;keeping with guidance issued by the relevant professional body. You must continue to satisfy the applicable fitness-to-practise requirements in&nbsp;order to remain registered.<\/p>\n\n\n\n<p><strong>2.4<\/strong><br>The Institution will abide by its own rules and&nbsp;regulations. It reserves the right to add to, delete and\/or make reasonable changes where&nbsp;this assists in&nbsp;the proper delivery of education or&nbsp;is in&nbsp;the interests of students. Such changes may be made in&nbsp;order to:<\/p>\n\n\n\n<p>\u2013 review and&nbsp;update rules to ensure fitness for&nbsp;purpose;<br>\u2013 safeguard academic standards;<br>\u2013 reflect legal, regulatory, governmental or&nbsp;funding changes;<br>\u2013 incorporate sector guidance or&nbsp;best practice;<br>\u2013 incorporate feedback from students;<br>\u2013 aid clarity or&nbsp;consistency.<\/p>\n\n\n\n<p><strong>2.5<\/strong><br>Where the Institution makes changes to its rules and&nbsp;regulations, it will make reasonable efforts to bring them to your attention before&nbsp;they take effect. Updated rules and&nbsp;regulations will be made available on&nbsp;the learning portal.<\/p>\n\n\n\n<p><strong>2.6<\/strong><br>Changes will normally take effect at&nbsp;the beginning of the next academic year. The Institution reserves the right to introduce changes during the academic year where&nbsp;required by law or&nbsp;in exceptional circumstances. Efforts will be made to minimise disruption, for&nbsp;example by giving notice or&nbsp;by phasing in&nbsp;changes.<\/p>\n\n\n\n<p><strong>2.7<\/strong><br>Minor or&nbsp;reasonable variations to rules, regulations or&nbsp;programme delivery do not constitute a&nbsp;breach of contract and&nbsp;do not entitle students to refunds, compensation or&nbsp;chargebacks. Adjustments made to preserve educational quality or&nbsp;safety are considered normal academic practice.<\/p>\n\n\n\n<hr class=\"wp-block-separator\"\/>\n\n\n\n<h1><strong>3. Registration at&nbsp;the Institution<\/strong><\/h1>\n\n\n\n<p><strong>3.1<\/strong><br>Before registering at&nbsp;the Institution, you shall:<\/p>\n\n\n\n<p>a. comply with any conditions set out in&nbsp;your offer of admission;<br>b. inform the Institution of any criminal convictions in&nbsp;the circumstances set out in&nbsp;the Admissions Policy;<br>c. where&nbsp;necessary, obtain the correct visa granting entitlement to enter and&nbsp;remain in&nbsp;the UK for&nbsp;study;<br>d. ensure that&nbsp;the content, accreditation and&nbsp;recognition of your chosen programme are appropriate for&nbsp;your needs and&nbsp;accepted in&nbsp;the region(s) in&nbsp;which you intend to operate. Programmes vary in&nbsp;content, delivery, scope and&nbsp;accreditation. It is&nbsp;solely your responsibility to ensure you are on&nbsp;the correct programme for&nbsp;your requirements.<\/p>\n\n\n\n<p><strong>3.2<\/strong><br>The Institution may terminate or&nbsp;suspend your registration if:<\/p>\n\n\n\n<p>a. you acted dishonestly or&nbsp;omitted significant information in&nbsp;your application;<br>b. criminal convictions make you unsuitable for&nbsp;study;<br>c. disciplinary procedures find you in&nbsp;breach of conduct;<br>d. a&nbsp;Fitness to Study procedure determines you cannot continue;<br>e. you are unable to demonstrate valid immigration permission;<br>f. Fitness to Practise procedures determine you cannot continue;<br>g. any other relevant rules or&nbsp;regulations are breached.<\/p>\n\n\n\n<p><strong>3.3<\/strong><br>Upon registration, you automatically become a&nbsp;member of Apsley Business School Alumni (\u201cABSU\u201d). You may opt out at&nbsp;any time under section 22 of the Education Act 1994.<\/p>\n\n\n\n<p><strong>3.4<\/strong><br>The Institution endorses and&nbsp;supports student exchange programmes with partner institutions. In such cases, you will be registered at&nbsp;the partner institution and&nbsp;may not receive an Apsley student number, nor&nbsp;be eligible for&nbsp;sponsorship for&nbsp;visa purposes. You may apply to join ABSU and&nbsp;may attend Convocation with permission.<\/p>\n\n\n\n<hr class=\"wp-block-separator\"\/>\n\n\n\n<h1><strong>4. Fees<\/strong><\/h1>\n\n\n\n<p><strong>4.1<\/strong><br>You agree to pay, or&nbsp;make acceptable arrangements to pay, all deposits, fees, charges and&nbsp;expenses when&nbsp;due. Fees are collected as&nbsp;walk-in sales (not distance selling). For online provision, programmes are considered download and&nbsp;streaming services under the Consumer Rights Act 2015. Once fees are received, there will be no refund.<\/p>\n\n\n\n<p><strong>4.1A \u2013 Digital Content Waiver<\/strong><br>By logging into the learning portal, accessing digital materials, streaming lectures, attending any induction or&nbsp;teaching, or&nbsp;receiving any digital content, you expressly agree that:<br>\u2013 digital content delivery begins immediately;<br>\u2013 you waive your right to the 14-day cancellation period under the Consumer Contracts Regulations 2013.<\/p>\n\n\n\n<p><strong>4.1B \u2013 No Refund Policy<\/strong><br>Once any access to digital or&nbsp;learning materials has been granted, there are no refunds under any circumstances, including but&nbsp;not limited to withdrawal, non-engagement, personal circumstances, relocation, dissatisfaction or&nbsp;technical issues on&nbsp;the student\u2019s side.<\/p>\n\n\n\n<p><strong>4.2<\/strong><br>Failure to pay fees when&nbsp;due may lead to sanctions, including suspension of access to Institution facilities or&nbsp;termination of registration.<\/p>\n\n\n\n<p><strong>4.3 \u2013 Chargeback Restrictions<\/strong><br>You must complete the Institution\u2019s internal complaints procedure before&nbsp;initiating any external dispute, chargeback or&nbsp;Section 75 claim. Initiating a&nbsp;chargeback without exhausting internal procedures constitutes a&nbsp;breach of Contract. The Institution will provide full evidence of delivery\u2014including access logs, login timestamps, academic submissions and&nbsp;communications\u2014to the payment provider.<\/p>\n\n\n\n<p><strong>4.4 \u2013 Definition of Delivery<\/strong><br>Delivery of the programme is&nbsp;deemed fulfilled once&nbsp;access to the learning portal has been issued. Non-engagement does not constitute non-delivery.<\/p>\n\n\n\n<hr class=\"wp-block-separator\"\/>\n\n\n\n<h1><strong>5. Accommodation<\/strong><\/h1>\n\n\n\n<p><strong>5.1<\/strong><br>You are responsible for&nbsp;your own accommodation and&nbsp;insurance arrangements unless&nbsp;separate agreements apply.<\/p>\n\n\n\n<hr class=\"wp-block-separator\"\/>\n\n\n\n<h1><strong>6. International Students<\/strong><\/h1>\n\n\n\n<p><strong>6.1<\/strong><br>You are responsible for&nbsp;obtaining your visa or&nbsp;other permission to enter and&nbsp;study in&nbsp;the UK. If you do not secure valid immigration status, you may not start your programme. If your permission expires or&nbsp;is breached during your programme, the Institution may be required to inform UKVI and&nbsp;require you to leave the programme.<\/p>\n\n\n\n<p><strong>6.2<\/strong><br>If the Institution sponsors your visa, it will inform you of your obligations. You must check that&nbsp;all details on&nbsp;your CAS are accurate. A CAS will be issued once&nbsp;all admission conditions are met.<\/p>\n\n\n\n<hr class=\"wp-block-separator\"\/>\n\n\n\n<h1><strong>7. Students with Disabilities<\/strong><\/h1>\n\n\n\n<p><strong>7.1<\/strong><br>If you have a&nbsp;disability, you are encouraged to disclose this early so&nbsp;that&nbsp;support may be arranged. Admissions decisions normally depend on&nbsp;academic suitability, but&nbsp;some programmes also require professional competency assessments.<\/p>\n\n\n\n<p><strong>7.2<\/strong><br>The Institution will make reasonable adjustments to avoid disadvantaging disabled applicants or&nbsp;students. However, where&nbsp;adjustments cannot reasonably be made, the Institution may not be able to offer or&nbsp;continue the programme.<\/p>\n\n\n\n<hr class=\"wp-block-separator\"\/>\n\n\n\n<h1><strong>8. Academic Study<\/strong><\/h1>\n\n\n\n<p><strong>8.1<\/strong><br>You agree to:<\/p>\n\n\n\n<p>a. participate fully in&nbsp;your programme, including classes, activities and&nbsp;assessments;<br>b. notify the Institution if&nbsp;you are unable to attend or&nbsp;submit work;<br>c. maintain academic integrity;<br>d. submit work to Turnitin UK;<br>e. acknowledge lecture-capture usage and&nbsp;your right to opt out;<br>f. keep captured lectures and&nbsp;provided&nbsp;materials confidential and&nbsp;use them only for&nbsp;personal study.<\/p>\n\n\n\n<p><strong>8.1A \u2013 Engagement Clarification<\/strong><br>Failure to attend classes, log in, participate or&nbsp;submit assessments does not constitute non-delivery of educational services by the Institution.<\/p>\n\n\n\n<p><strong>8.1B \u2013 Evidence of Participation<\/strong><br>The Institution retains portal login records, content access logs, assignment timestamps and&nbsp;attendance records as&nbsp;evidence of programme delivery.<\/p>\n\n\n\n<hr class=\"wp-block-separator\"\/>\n\n\n\n<h1><strong>9. Disclaimers<\/strong><\/h1>\n\n\n\n<p><strong>9.1<\/strong><br>The Institution will do all that&nbsp;it reasonably can to provide you with the educational and&nbsp;other services and&nbsp;facilities described in&nbsp;its material information.<\/p>\n\n\n\n<p><strong>9.2<\/strong><br>Circumstances beyond the Institution\u2019s control (\u201cEvents Outside of Our Control\u201d) may prevent delivery of services despite reasonable care. Such events include, but&nbsp;are not limited to:<\/p>\n\n\n\n<p>\u2013 unexpected absence of key staff;<br>\u2013 terrorism, war or&nbsp;national emergencies;<br>\u2013 pandemics, epidemics or&nbsp;health crises;<br>\u2013 fire or&nbsp;flood;<br>\u2013 severe weather;<br>\u2013 natural disasters;<br>\u2013 political or&nbsp;civil unrest;<br>\u2013 power failures;<br>\u2013 damage or&nbsp;interruption to facilities or&nbsp;equipment;<br>\u2013 acts or&nbsp;delays of governmental authorities;<br>\u2013 industrial action;<br>\u2013 legal or&nbsp;regulatory changes;<br>\u2013 withdrawal of licences;<br>\u2013 insufficient student numbers.<\/p>\n\n\n\n<p><strong>9.3<\/strong><br>Where Events Outside of Our Control occur, the Institution will notify you and&nbsp;take reasonable steps to minimise disruption, such as:<\/p>\n\n\n\n<p>\u2013 offering transfers to another programme;<br>\u2013 deferring the start date;<br>\u2013 delivering a&nbsp;programme in&nbsp;a&nbsp;different way or&nbsp;location;<br>\u2013 delivering a&nbsp;modified version of the programme;<br>\u2013 assisting students to transfer elsewhere;<br>\u2013 delivering services in&nbsp;alternative formats.<\/p>\n\n\n\n<p><strong>9.4<\/strong><br>If you are not satisfied with such mitigating steps, you may terminate your Contract. Termination under this clause does not create any entitlement to a&nbsp;refund of fees already paid, which&nbsp;remain governed by section 4 of these Terms and&nbsp;Conditions.<\/p>\n\n\n\n<p><strong>9.5<\/strong><br>If Events Outside of Our Control require closure or&nbsp;discontinuation of a&nbsp;programme, the Institution will follow its Student Protection Plan.<\/p>\n\n\n\n<p><strong>9.6<\/strong><br>Where Events Outside of Our Control occur and&nbsp;the Institution cannot minimise disruption, neither party is&nbsp;liable for&nbsp;breach of Contract.<\/p>\n\n\n\n<p><strong>9.7<\/strong><br>The Institution will use reasonable endeavours to deliver teaching and&nbsp;related services in&nbsp;accordance with published descriptions but&nbsp;may make reasonable changes to enhance quality.<\/p>\n\n\n\n<p><strong>9.8<\/strong><br>Changes may be made to:<\/p>\n\n\n\n<p>a. content and&nbsp;syllabus;<br>b. timetable, location or&nbsp;number of classes;<br>c. structure or&nbsp;timing of the academic year;<br>d. method of delivery;<br>e. examination or&nbsp;assessment methods.<\/p>\n\n\n\n<p>Students will be notified, and&nbsp;disruption minimised.<\/p>\n\n\n\n<p><strong>9.9<\/strong><br>Students affected by substantial changes may withdraw and&nbsp;will be offered support in&nbsp;transferring to another programme.<\/p>\n\n\n\n<p><strong>9.10 \u2013 Delivery Mode Flexibility<\/strong><br>Adjustments to delivery methods\u2014including staffing changes, online delivery, timetabling changes or&nbsp;modified teaching formats\u2014do not constitute non-delivery and&nbsp;do not entitle students to refunds or&nbsp;chargebacks, provided&nbsp;learning outcomes remain deliverable.<\/p>\n\n\n\n<p><strong>9.11<\/strong><br>The Institution does not accept responsibility for&nbsp;loss or&nbsp;damage to students\u2019 property or&nbsp;infection of students\u2019 equipment by computer viruses.<\/p>\n\n\n\n<p><strong>9.12<\/strong><br>The Institution does not accept responsibility for&nbsp;loss arising from a&nbsp;student failing to ensure that&nbsp;programme content or&nbsp;accreditation is&nbsp;appropriate or&nbsp;recognised in&nbsp;their region.<\/p>\n\n\n\n<hr class=\"wp-block-separator\"\/>\n\n\n\n<h1><strong>10. Communications<\/strong><\/h1>\n\n\n\n<p><strong>10.1<\/strong><br>The Institution may provide you with an Apsley email account for&nbsp;the duration of your studies and&nbsp;will use it for&nbsp;communication.<\/p>\n\n\n\n<p><strong>10.2<\/strong><br>You must:<\/p>\n\n\n\n<p>a. use your Apsley account when&nbsp;contacting staff;<br>b. use the Online Learning Portal to submit assignments;<br>c. update your personal details via the Student Portal;<br>d. agree any use of social media for&nbsp;communication with supervisors;<br>e. adhere to high standards of online conduct.<\/p>\n\n\n\n<hr class=\"wp-block-separator\"\/>\n\n\n\n<h1><strong>11. Personal Data Collection, Publication and&nbsp;Sharing<\/strong><\/h1>\n\n\n\n<p><strong>11.1<\/strong><br>By entering into this Contract, you understand that&nbsp;the Institution and&nbsp;its partners may process your personal data to deliver education services.<\/p>\n\n\n\n<p><strong>11.2<\/strong><br>The Institution needs to collect and&nbsp;process personal data\u2014including student records, applications, assessment marks, attendance data, learning platform access and&nbsp;financial data.<\/p>\n\n\n\n<p><strong>11.3<\/strong><br>At enrolment you will be asked to consent to processing of special category personal data, which&nbsp;is&nbsp;optional.<\/p>\n\n\n\n<p><strong>11.4<\/strong><br>The Institution processes personal data in&nbsp;accordance with data protection legislation, its Data Protection Policy and&nbsp;the Student Data Privacy Notice. Queries may be addressed to:<\/p>\n\n\n\n<p><strong>Data Protection Officer<\/strong><br>Third Floor Apsley House<br>London, SW15 2SH<br><a href=\"http:\/\/www.apsley.eu\">www.apsley.eu<\/a><br><a>gdpr@apsley.university<\/a><\/p>\n\n\n\n<p>Your student ID, results and&nbsp;email address may be visible to other students in&nbsp;the Student Portal or&nbsp;VLE.<\/p>\n\n\n\n<p><strong>11.5<\/strong><br>When you leave, your details will be passed to the Alumni Office, where&nbsp;they will be processed under the Alumni Privacy Notice.<\/p>\n\n\n\n<hr class=\"wp-block-separator\"\/>\n\n\n\n<h1><strong>12. Attendance and&nbsp;Academic Regulations<\/strong><\/h1>\n\n\n\n<p><strong>12.1<\/strong><br>You must observe the Academic Regulations and&nbsp;fulfil all attendance, engagement and&nbsp;assessment obligations. Failure to comply with these regulations will prevent you from satisfactorily completing your registered programme of study and&nbsp;may result in&nbsp;sanctions, including termination of registration, in&nbsp;accordance with the Academic Regulations.<\/p>\n\n\n\n<hr class=\"wp-block-separator\"\/>\n\n\n\n<h1><strong>13. If Things Go Wrong<\/strong><\/h1>\n\n\n\n<p><strong>13.1<\/strong><br>Complaints must be made through the Student Complaints Procedure, designed to resolve issues promptly and&nbsp;fairly.<\/p>\n\n\n\n<p><strong>13.1A \u2013 Mandatory Internal Resolution<\/strong><br>You agree not to initiate any chargeback, external dispute or&nbsp;legal claim without first completing the Institution\u2019s internal complaints and&nbsp;mediation procedures. Failure to do so&nbsp;constitutes a&nbsp;breach of Contract.<\/p>\n\n\n\n<p><strong>13.2<\/strong><br>If you remain dissatisfied after&nbsp;completing the complaints procedure, you may request mediation with a&nbsp;third party nominated by the Institution.<\/p>\n\n\n\n<p><strong>13.3<\/strong><br>The Institution may take action against you under disciplinary regulations or&nbsp;policies where&nbsp;necessary. One possible outcome is&nbsp;termination of registration. You agree that&nbsp;all relevant staff will be advised of the outcome.<\/p>\n\n\n\n<hr class=\"wp-block-separator\"\/>\n\n\n\n<h1><strong>14. Notices<\/strong><\/h1>\n\n\n\n<p><strong>14.1<\/strong><br>Notices to the Institution must be sent to:<\/p>\n\n\n\n<p><strong>Academic Committee Chair<\/strong><br>Third Floor Apsley House<br>London SW15 2SH<br><a href=\"http:\/\/www.apsley.eu\">www.apsley.eu<\/a><br><a>admission.support@apsley.university<\/a><\/p>\n\n\n\n<p><strong>14.2<\/strong><br>Notices to you are properly served if&nbsp;sent to your last known postal address or&nbsp;to your Apsley email account.<\/p>\n\n\n\n<hr class=\"wp-block-separator\"\/>\n\n\n\n<h1><strong>15. General<\/strong><\/h1>\n\n\n\n<p><strong>15.1<\/strong><br>This Contract is&nbsp;enforceable only by you and&nbsp;the Institution.<\/p>\n\n\n\n<p><strong>15.2<\/strong><br>If any part of this Contract is&nbsp;found illegal or&nbsp;invalid, the remainder shall continue in&nbsp;force.<\/p>\n\n\n\n<p><strong>15.3<\/strong><br>Failure to enforce any part of this Contract does not constitute a&nbsp;waiver of the right to enforce it later.<\/p>\n\n\n\n<p><strong>15.4<\/strong><br>All representations not expressly set out in&nbsp;this Contract are excluded to the fullest extent permitted by law.<\/p>\n\n\n\n<p><strong>15.5<\/strong><br>This Contract is&nbsp;governed by the law of England and&nbsp;Wales. You submit to the exclusive jurisdiction of the English courts.<\/p>\n\n\n\n<p><strong>15.6 \u2013 Order of Dispute Resolution<\/strong><br>Any legal dispute may be brought only after&nbsp;the Student Complaints Procedure and&nbsp;mediation have been completed.<\/p>\n\n\n\n<hr class=\"wp-block-separator\"\/>\n\n\n\n<h1><strong>16.
